LinkedIn Users Sucker-Punched by Wrong References

In the November 11, 2014 Ask The Headhunter Newsletter, we examine yet another questionable LinkedIn “feature” that could cost you a job.

Question

The New York Times just did a story about a group of people suing LinkedIn for selling possibly invalid references to employers. Now LinkedIn has gone too far. This is causing employers to reject job applicants, and the applicants didn’t even provide the references! What do you think of this career sucker-punch?

Here’s the bottom line: There is zero integrity in LinkedIn’s “Trusted References” sales pitch. While LinkedIn sells employers a reference checking service, it defends against the lawsuit by saying it’s not really selling a reference checking service — it’s just selling a list of names.

And LinkedIn thereby throws its own integrity into the toilet. I don’t see how any employer could even contemplate using such a “service.” in-your-faceIt really is a sucker-punch — LinkedIn connects an employer with wrong “references” and you can’t even defend yourself.

I’ve got over 500 LinkedIn connections — most of whom I’ve never met. Some may have crossed my path at a company with thousands of employees. How irresponsible is it of LinkedIn to sell those overlaps as my
“trusted references?”

What are references?

What if I’m a food critic and I write a newspaper column that tells you a restaurant is no good? You buy the paper and avoid the restaurant. Can the restaurant sue me for loss of business? Even though money changed hands for “data,” do you really think a restaurant critic could go to jail?

I think the New York Times did a poor job covering this story, because it confuses several issues and fails to clearly point to the real problem.

Before we get into that, let’s remember that references make commerce possible. They are an important part of business. People’s opinions and judgments about us — and about products, services, brands and companies — are the coin of the realm in any economy. When smart employers hire and when good headhunters recruit, we check relevant opinions and judgments first, to make sure we know who (and what) we’re dealing with. That’s why your reputation — and any company’s reputation — is so important.

It makes no sense to suggest that checking references before hiring someone is inappropriate, or that rejecting someone for a job because of poor references is wrong. It’s due diligence. The Times seems to confuse seeking and sharing opinions with privacy. I think the lawsuit does, too.

But that’s where the controversies start. The Times doesn’t address certain questions, and I’m not going to, either, because this isn’t an analysis of references. Nonetheless, I’ll bait your confusion by posting some of the questions I think need to be answered:

  • What is a reference?
  • Who owns references?
  • How far can an employer go when checking references?
  • Can you buy a reference?
  • What does an employer pay for when using LinkedIn to check references?
  • For that matter, what do you pay for when using LinkedIn to make contacts or to get a job?
  • Are people free to ask about you and talk about you if they want?
  • What if someone decides not to do business with you based on what they learn from others?

America’s employment system has become such a jumble of promises, marketing, expectations, data and databases that everyone seems incredibly confused about what’s right, wrong, possible or legal.

I’m not a lawyer, so this is not a legal opinion or legal advice. I’m a headhunter and my comments are based on (I hope) my business sense. What others say about your professional reputation matters a lot, and it does — and should — influence whether someone wants to hire you. But, what if a fencepost is checking your references?

Reference checking requires integrity

Headhunters — like homeowners looking to hire plumbers — check opinions and judgments all the time. We’ll make discreet inquiries to find out who you are, how good you are at your work, and what you’re like to work with. If we hear something out of the ordinary — positive or negative — we must have the good sense to double- and triple-check the information before we risk our own reputations by referring you to our clients. Like good restaurant critics, we realize that opinions we gather will have consequences.

Trureferences-glassst and integrity are the hallmarks of our business — which is why I say about 95% of headhunters aren’t worth spit. Too many are in the business for a quick buck, and their own judgment stinks (to say nothing of their skills). It’s up to you — the consumer — to use your head before you rely on a headhunter, whether you’re a job seeker or an employer.

Likewise, it’s up to employers to judge what LinkedIn is selling them when it delivers lists of references. And it’s up to employers to ensure that their own in-house recruiters know how to select, check and evaluate references properly. In my opinion, 95% of in-house recruiters can’t be trusted with the task, and no one is the wiser. Worse, many employers outsource reference checking and have no idea whether the results are valid or reliable.

My point is, you have no idea where your references will come from or who is checking them — any more than a restaurant does. So be careful.

What did LinkedIn do?

According to the lawsuit in the U.S. District Court of the Northern District of California:

“LinkedIn has created a marketplace in consumer employment information, where it sells employment information, that may or may not be accurate, and that it has obtained in part from unwitting members, and without complying with the FCRA [Fair Credit Reporting Act].”

The problem, plaintiffs say, is that:

“any potential employer can anonymously dig into the employment history of any LinkedIn member, and make hiring and firing decisions based upon the information they gather, without the knowledge of the member, and without any safeguards in place as to the accuracy of the information that the potential employer has obtained.”

In other words, plaintiffs claim LinkedIn is selling information that leads employers to inappropriately rejecting people for jobs. They also suggest that there may be some violation of privacy. I asked employment lawyer Mark P. Carey about the privacy issue. He says:

“Everyone who maintains a LinkedIn account should expect that their information is public.That’s why we have these personal/professional marketing pieces. There is no privacy issue as far as I can see, especially if you signed the user agreement before gaining access to host your own page.”

But I do think LinkedIn has a problem. First, LinkedIn takes money for what it advertises as “Trusted References for Job Candidates.” In so many words, LinkedIn suggests the references an employer pays to access about you are accurate — “Trusted.” That’s where I think LinkedIn crosses the line, whether legally or with regard to its own integrity. LinkedIn cannot possibly know whether those references are trustworthy. So how can it pitch them with impunity to employers — or defend them to job seekers?

When people are rejected for jobs because of questionable references, we’ve all got a problem. LinkedIn especially.

Elsewhere in its Help section, LinkedIn says:

“A reference search locates people in your network who can provide reliable feedback about a job candidate or business prospect.”

That is, LinkedIn represents that an employer can rely on the references to justify hiring you or rejecting you. In fact, it uses those words to lure employers into buying those lists.

However, LinkedIn spokesman Joseph Roualdes tries to alter LinkedIn’s own representations when he tells the Times, “A [paid] reference search… simply lets a searcher locate people in their network who have worked at the same company during the same time period as a member they would like to learn more about.”

Suddenly, LinkedIn isn’t selling anymore. It’s covering its ass. The truth is on the web site: LinkedIn promises that the references employers are buying are “Trusted” and “reliable.”

References or just a list of names?

Here’s where I think the going gets dicey for the plaintiffs. Regardless of what LinkedIn sells and promotes — references — LinkedIn does not seem to really deliver references. It apparently delivers only a list of names. It’s up to the employer to talk to those people and ask them for references.

It seems to me that if the plaintiffs were rejected by employers due to bad references, the plaintiffs should be suing the references themselves for defamation — or the employers.

defamationLawyer Carey fleshes out the defamation issue for us:

“The real underlying issue here is whether and to what extent an act of defamation occurred… There is no legal claim there for anything, not even defamation. The article and the lawsuit dance across the fringe of privacy and defamation, without any substance. Only when a search adds content that provides a qualification uniquely driven at the particular candidate, then someone crosses the legal line of what is neutral and what is defamatory.”

But it doesn’t seem LinkedIn is “adding content.” That is, it doesn’t deliver the text of a reference, so there’s no defamatory statement.

Perhaps the employers who paid for those names have an action they can bring if the names yield inaccurate references when LinkedIn promises otherwise — but I don’t see how a job seeker could sue LinkedIn successfully because it sold names. That seems to be covered in the company’s terms and conditions.

The Times compares this suit to one against Spokeo, an online data broker which “agreed to pay $800,000 to settle accusations” that it marketed reports to recruiters and background screeners without providing consumers with protections afforded by the law.”

But LinkedIn doesn’t seem to sell reference reports about anyone. Again, I don’t see how LinkedIn can be liable for a bad reference. The data that employers rely on to make decisions did not come from LinkedIn; only names came from LinkedIn.

The larger problem is that mindless employers believe ridiculous advertisements by LinkedIn that claim a list of names are “Trusted References… who can provide reliable feedback about a job candidate.”

(Remember, we’re talking about the same “professional networking” company that charges employers for lists of the best job candidates — while it sells high rankings on those lists to job applicants! We’re talking about the same employers that know this yet still pay LinkedIn to find job candidates! See LinkedIn Payola: Selling out employers and job hunters.)

fencepostSays the Times: “Sophisticated recruiters would not waste their time contacting people who clearly had no connection of significance to a job candidate.”

But they do, and if the New York Times is going to skate over this key fact, then it’s drawing the wrong conclusions, because most HR recruiters are fenceposts. Just ask any job seeker that deals with them. (See Why do recruiters suck so bad?)

Those same recruiters stupidly waste their time interviewing candidates simply because LinkedIn represents that the “profiles” it sells are “accurate.” Is it any surprise that recruiters are suckered into making hiring decisions based on “references” that may not be accurate?

A law professor cited in the article concludes, “A company can now decide which people associated with you can be curators of your reputation in situations that matter.”

But companies have always done that. The trouble is, now there’s no need to verify that a reference is legit — that is, valid or reliable. Because LinkedIn ensures us that it is.

What’s the real problem?

LinkedIn does not sell reference reports or reference information, so I don’t think anyone can hold it liable when employers reject applicants based on comments made by a list of people LinkedIn sells.

I think the wrong plaintiffs are suing. Employers should be suing LinkedIn for its failure to take reasonable measures to ensure that the lists of references it sells are in fact “Trusted References” and that they “can provide reliable feedback about a job candidate.”

Just how stupid are recruiters who “trust” LinkedIn references? The Times reporter says the plaintiff’s lawyer showed her that recruiters have no idea what they’re buying — or whether they’re calling real references at all. The lawyer ran a “LinkedIn reference search” on the reporter:

“The search produced a list of 43 people in his network who currently work or have done work for this newspaper — including a former I.T. consultant, a freelance contributor and two former interns. I had met only four people on that reference list, and none of them had direct experience working with me.”

Just imagine: A recruiter uses LinkedIn to search his network for people who are your “Trusted References” — but the recruiter has no idea whether any of them had any direct experience working with you.

You get rejected, because someone who never worked with you provided a questionable reference. (As I pointed out, I don’t know most of my connections, thanks to LinkedIn’s marketing mission to link everyone. What if a personnel jockey gets hold of an overlapping contact and trusts it as a reference about me — and I get screwed?)

The underlying question — and concern — is, how skilled is the reference checker, and is the check done properly and with integrity?

The recruiter’s purchase of a list from LinkedIn becomes the faux justification for one potentially bad decision after another — and one unemployed LinkedIn user after another.

Have you been sucker-punched by wrong references?

LinkedIn’s “Trusted References” service is a cheap sucker-punch straight to your career and reputation. Now any personnel jockey can “check a reference” on LinkedIn without having the faintest idea what she’s doing — and you get screwed out of a job. For that reason alone, I hope LinkedIn gets its ass sued sixteen ways from Sunday. I’m not sure this suit will succeed, because I think it focuses on the wrong issues. But the legal issues are for the lawyers and the courts.

The business issue is, LinkedIn is talking out of two sides of its mouth. It markets a references service to employers, while telling the judge it’s really no such thing. And employers buy both stories.

Perhaps more to the point, since it’s consumers suing LinkedIn, those consumers need to admit that they bought into a marketing machine that uses their personal information to make money at their expense — and they agreed to the terms. When someone walks straight into a sucker-punch, it’s hard to sympathize with them.

Lots of questions remain. Whatever happens with this suit — or others that I hope it spawns — the thing that’s clear is LinkedIn’s marketing strategy: There’s a sucker born every minute, and we’re going to sell them all anything they’re willing to swallow.

How employers help scammers steal your Social Security number

It was inevitable: Scammers are stealing job seekers’ identities using over-the-top interview protocols established by employers to gather sensitive personal data. Have employers gone too far demanding too much of job applicants before they even need the information?

Great news! A well-known employer in your area sends you an e-mail saying it wants to interview you by phone — they found your resume online or your profile on LinkedIn. You answer the phone at the appointed time and have a job interview. Perhaps the interviewer makes an offer on the spot — your lucky day! He helps you complete the job application right there on the phone. What’s not to like?

steal-ssnHighmark, a BlueCross BlueShield healthcare company, warns on its website that the interview you think the company just conducted with you was a fraud — and someone stole your private information in the process:

Recently, Highmark has received several reports of possible fraudulent online activity in which an individual posing as a Highmark human resources representative contacts job seekers by e-mail or phone/text, conducts interviews and makes employment offers on behalf of the company. In most instances, those contacted have never applied for a position with Highmark. These false job offers are likely made in an attempt to gain access to your private information, such as your social security number.

While fake online job postings are common and used to get you to fill out forms with personal information that can be used to steal your identity, this fraud is bold. Someone posing as a well-known employer actually calls you up and interviews you — and by the time it’s over you’ve got a phony job offer and the scammers have your very real social security number and other private information.

How can this happen?

An alert job seeker might recognize a phony e-mail address behind the official-sounding name of the company and the recruiter. But some won’t. Job seekers are understandably excited to get an e-mail asking for an interview and will quickly follow the “script” we’re all accustomed to — an e-mail expressing interest, a phone interview with a recruiter, and an intimidating demand for highly detailed “job application” information that includes private personal data that no employer really needs — but demands anyway.

Of course, not all victims will believe they just got a job offer on the phone without an in-person interview — but some will. And even if the “recruiter” doesn’t make an offer on the phone, he makes it awfully easy to “complete the application” on the phone while he does all the writing for you. He’ll even write down your social security number and your home address and phone number. What’s not to like?

How employers help scammers steal your SS#

Employers have programmed job seekers to quickly disclose private, confidential information — when there’s no real benefit to doing so, but lots of risk. Long before the employer decides you’re even a serious contender for a job, it demands your home address, your social security number, names and contact information of your references and permission to contact them, your salary history (which you should never disclose) and loads of other information that’s none of their business at this juncture and which they don’t even need. (When you fork over your references, you’re putting them at risk, too — probably not a good idea if you want good references!)

Why do HR departments routinely demand all this information? Simply because they can. You’ve been trained to  deliver “the required information” just to apply — while the employer hasn’t even checked your qualifications or indicated the slightest interest in talking with you much less hiring you. (See Does HR Go Too Far When Screening Candidates? — especially comments by HR manager Earl Rice. As you’ll note from the 2003 date on this article, this is not a new employer protocol.)

That’s why you become an easy target for scammers. Scammers exploit the intimidating “script” employers have taught you to follow. That’s how unreasonable, over-the-top job application requirements put you at risk. But it’s even worse.

Where’s your data?

Even a real, live employer that collects your private information puts you at risk. Many employers use third-party applicant tracking systems (ATSes) to log your application information and personal data. It all goes into “the cloud” — and good luck protecting it. When you complete that application, you’re usually asked to sign a waiver that gives the employer and its “agents” (translation: any third parties it deals with but that you don’t know about) permission to do with your data as they please.

You have no idea where your data goes, who has access to it, or how well (if at all) it is secured. Personal job application data is stored in unregulated, central repositories that even employers have no control over. Who controls these enormous databases? Companies like Oracle Taleo, Bullhorn, HRIS, IBM’s Kenexa, iCIMS, JobVite, HireBridge, JobScore, and ADP VirtualEdge among others. Of course, to apply for a job you must provide basic information. But it’s up to you to be judicious about what you share and at what point in the recruiting process. Do they really need your social security number — when they haven’t even met you or given you any clear indication that they’re going to make a job offer? Most people today have already been brainwashed by the employment system to hand over anything and everything an employer says it “needs” to “process you.”

BAM! It’s that misconception that turns you into a sucker when a phony recruiter calls you and asks for all your data.

It’s time for employers to behave

It’s time for employers to stop demanding information they don’t need to recruit you. Today, HR departments ask for the kitchen sink simply because they have a database for kitchen sinks. “We’ll just get all the person’s data up front, so we don’t have to do it later.” More cynically, “We’ll get all their data before we even decide they’re viable candidates because then we can use a keyword scan to quickly reject people we haven’t even talked to yet.” (Less politely: Presumptuous Employers: Is this HR, or Proctology?)

When employers put some of their own skin in the game, then they can ask applicants to do the same. For example, what’s the salary range on the job? How much did you pay the last guy in that job and the one before that? What’s your Employer Identification Number? May I see some references from your customers, vendors and former employees? How about your credit rating? You’re privately held? I still need that information — I’m privately held, too. Are some of those questions over the top? Hmmm…

It’s also time for job seekers to stop being suckers. You are always free to politely but firmly decline to disclose any information you think is too private to share — until you think it’s warranted to process your job offer. Don’t be a sucker for either a legitimate employer who asks for too much — or for a scammer. LinkedIn: Busted for U.S. wage law violations, sued for “injury” to users

LinkedIn busted by U.S. Department of Labor

It’s no big deal, suggests LinkedIn.

linkedin-hackAccording to a Computerworld report (LinkedIn pays almost $6M for U.S. wage law violations), LinkedIn was busted by the U.S. Department of Labor (DOL) when it “violated overtime and record-keeping provisions under the federal Fair Labor Standards Act.”

DOL investigators found that the online networking and job-board company “did not record, account and pay for all hours worked in a work-week.”

359 current and former employees were affected at LinkedIn’s branches in California, Illinois, Nebraska and New York. LinkedIn agreed to make restitution to those employees. “The payment to the workers under the accord includes over $3.3 million in overtime back wages and about $2.5 million in damages,” says Computerworld.

The high-tech database company, which tracks the online profiles and behavior of over 300 million members, many of whom pay for the service, told Computerworld that the violations were “a function of not having the right tools in place for a small subset of our sales force to track hours properly.”

Judge says consumer class action against LinkedIn can proceed

A judge in the U.S. District Court for the Northern District of California has ruled that a case against LinkedIn can proceed. Computerworld reported that “LinkedIn will have to face a lawsuit that alleges it damaged the image of users by repeatedly sending emails to their contacts inviting them to join the social network.”

At issue is whether LinkedIn derives “economic benefit” by using its existing members’ names to solicit other people to join the service. This is illegal in the State of California.

According to Computerworld’s report, Judge Lucy Koh ruled that, “The Court notes that this type of injury, using an individual’s name for personalized marketing purposes, is precisely the type of harm that California’s common law right of publicity is geared toward preventing.”

LinkedIn has taken a lot of heat from its users for its practice of cleverly scraping addresses from their private e-mail directories, and then spamming their contacts repeatedly with solicitations to “connect” on LinkedIn. LinkedIn has also been accused of conflict of interest because it charges employers to search its database for the best job candidates — while LinkedIn also charges members for “premium” positioning in those search results. Against LinkedIn’s protests, the court ruled that the case may proceed.

Is LinkedIn a network marketing scheme?

LinkedIn holds itself up as the standard bearer of ethical networking — yet more than half its revenues come from selling access to members’ information to third parties. In a Fortune article (LinkedIn’s Networker in Chief), LinkedIn CEO Jeff Weiner says:

  • “values are the first principles we use to make day-to-day decisions”
  • “Compassion has essentially become my first principle of management”

But based on these news stories, this quote says a lot about Weiner’s motivation and priorities:

“I didn’t realize until I got to LinkedIn that without access to economic opportunity, nothing else matters.”

It seems LinkedIn may have become too focused on its own “economic opportunity” and that the cost is being borne by its employees and members. Has the leading professional network turned into a sort of network marketing scheme?

The Bogus-ness of Indeed.com

In the April 2, 2014 Ask The Headhunter Newsletter, a reader asks me to stop dissing job boards:

You claim that job boards don’t work. Yet virtually every job in the world is advertised on job boards, and employers use job boards all the time! Just look at all the traffic they get. I think you’re missing the boat — please admit that there’s plenty of evidence the job boards do work!

Here’s the problem with job boards today: None of them offer any evidence that they work.

What does it mean that “they work?” It means they actually match people with jobs. You know: find jobs for people and find people for jobs.

Indeed-infographicAbout.com says, “The best sites for finding job listings in 2014 will help you find the most current job openings fast” (about.com). Finding job listings is one thing. But if job boards actually work, they should be able to show they are the cause of hires. They claim they are, but they offer no evidence.

Let’s look at Indeed.com, which is referred to as “arguably (and probably) the largest job search engine” (DigitalTrends).

On March 27, 2014, Indeed published an article and infographic titled “How 140 Million Unique Visitors Use Indeed to Find Jobs.”

On its face, the title seems clear — it’s going to tell you how people found jobs using Indeed. But the infographic shows nothing of the sort. In fact, contrary to the misleading title, the graphic seems to be very careful not to claim Indeed actually fills jobs. Let’s look at the data presented in that infographic (click here to follow along). It tells us everything except whether Indeed works:

1. 140 Million unique visitors each month. So what? What does tracking unique visitors have to do with actually filling jobs? All this tells us is that lots of people go there.

2. “Traffic on Indeed has increased by 40% over the past year.” Again, so what?

3. “Each month, 72% of online job seekers in the US visit Indeed.” But, how many get jobs there? There’s no mention of that. I’m still waiting for how all those people use Indeed to actually find jobs.

4. “There are 25 million resumes on Indeed that employers search for free.” Those employers could be printing resumes to line bird cages. Where are the stats on how many people they hired? All this statistic tells us is that employers might be stupid. Judging from the rising complaints about “a talent shortage” from employers, it seems “free” is worthless. And employers are indeed sometimes stupid.

5. “Job seekers use the 4 million employer reviews to research companies.” So what? They use Google to do the same. Does Google claim it fills jobs? Do we see a trend here? Lots of data showing big numbers, which seem impressive by themselves — but no outcomes analysis.

6. “45% of Indeed searches come from mobile.” Yah, so? Every marketing program today includes the obligatory reference to “mobile.” But how many of those searches yield hires?

7. There are 16 million jobs on Indeed worldwide, and 8.2 added per second. But how many are filled by people searching for jobs on Indeed?

8. Indeed is available in 50+ countries in 28 languages. Perhaps translators are getting jobs. What are the success rates by country?

The infographic slams us with impressive statistics about web traffic, numbers of job postings and resumes, percentages of job seekers that visit — all kinds of data. Indeed concludes that “More people find jobs on Indeed than anywhere else.” After scanning the clever infographic, you probably believe it.

Well, I don’t. I think it’s all b.s. All I see is that lots of people find job listings on Indeed. (Oops, could that be what Indeed really means?)

In the midst of all this promotional “info” there is not one shred of data that tells us how many people actually got jobs on Indeed, or how many jobs employers filled on Indeed. “People find jobs on Indeed” clearly means they found job listings in Indeed. So what?

The infographic is bogus. Those numbers do not indicate success rates. It’s classic deception by distraction that convinces people to keep patronizing job boards.

My challenge to job boards

I challenge Indeed.com, and every other job board: Show us your job fill rates and the success rates of job seekers who use the service, and point us to your data. Indeed’s revenues are not public, but they must be staggering. The company clearly spends a lot on advertising and promotion. You’d think that if Indeed had a shred of evidence that its service actually works, it would be prominently displayed in the infographic.

Why isn’t it?

I can’t find one word about Indeed’s success metrics on its website. Can you? Indeed features an “Engineering Blog” on its site — posts about database technology — but nothing about outcomes analysis or success metrics.

My guess is that Indeed’s dirty little secret is that human resources departments dump billions of dollars into an empty hole, and that nobody really cares how many jobs Indeed (or any job board) actually fills — as long as the cash keeps rolling in.

The job boards “show us the money” because they’re making it hand over fist. But they don’t show us results.

My challenge to employers:

I’ll make a second challenge to employers: Pay a job board only after you make a hire through that board. Suddenly, job boards will be able to accurately track who got hired from where. And you’ll know where your money is going. (This is no different from this challenge to job boards that charge job seekers.)

Funny thing

Every job board executive I’ve ever talked to claims that “there’s just no way we can track actual hires — it’s too complicated.” Gimme a break. Web analytics is rocket science today — we can track virtually everything you do online — and there’s no way to figure out whether a job board was the cause of a job being filled? Wouldn’t the very best job service be designed to ensure it gathers the necessary data to prove it works? I mean, what are all those “data scientists” for, anyway?

I think the truth is simpler: Indeed.com and most of the other job boards (the bigger, the worse) use deceptive marketing tactics to imply bogus benefits. Certainly, they fill some jobs, but just because millions of people gamble doesn’t mean enough of them win to justify the practice. All it means is that the house wins.

While you keep job hunting, you generate more visits to Indeed.com, which yields dramatic increases in “the data” — and in the number of suckers born every minute.

Federal Court OK’s Suit Against TheLadders: Breach of contract & deceptive practices

ladders3During the many years this blog has reported the questionable practices of TheLadders, angry Ladders customers who felt scammed often commented that someone should file a class action against the company. Their wishes have come true.

The United States District Court, Southern District of New York, has ruled that a consumer action lawsuit may proceed against TheLadders, a job board that long claimed to be “exclusive” for “only $100k+” job seekers and “only $100k+ jobs.”

The case was filed March 2013 by Bursor & Fisher, New York City consumer class action attorneys. A month after the filing, TheLadders CEO Alex Douzet appeared on WNYC radio and said, “This case has no merit, and we hope that it will be thrown out of the court quickly.”

In an order issued March 12, 2014, the federal Court denied TheLadders’ motion to dismiss the suit brought by its customers for “breach of contract” and “deceptive acts or practices.”

Plaintiffs in the case allege they paid for job postings and resume services that TheLadders failed to deliver, and that TheLadders used deceptive advertising that often appeared on the company’s website:

“TheLadders reviews each job listing found online or submitted by recruiters and employers before it’s posted to ensure it meets the criteria of a $100K+ position.”

The Court noted that TheLadders advertised itself as:

“a premium job site for only $100K+ jobs” where “[e]xperts pre-screen all jobs so they’re always 100K+” and members would “find hand-selected and pre-screened jobs that are $100K+.”

50000jobsPlaintiffs say that job positions either did not exist or had salaries less than TheLadders promised. But in its motion to dismiss the case, TheLadders asserts that its customers should know better than to confuse ads on the company’s website with promises the company makes in its contract. The Court noted in its order that:

“The defendant [TheLadders] argues that these representations were mere advertisements and were not terms of any contract.”

Some of the plaintiffs also allege that TheLadders “scammed” them and was “knowingly deceptive” when it offered an “expert resume critique” that was actually just a sales pitch copied from a “crib sheet.” One of the plaintiffs says a resume “expert” at TheLadders produced a scathing critique of his resume — which he had previously paid TheLadders to write for him.

TheLadders told the Court that its Terms of Use “disclosed that the website would not guarantee the quality of the job listings or the services.”

“…the resume plaintiffs’ allegation that misrepresenting a sales pitch as ‘expert resume critique’ is also sufficient to support an inference that the defendant’s behavior was ‘knowingly deceptive,’ especially in light of the alleged instructions to the sales personnel on how to represent themselves as ‘writer[s] and analyst[s]’ in order to convince the client about their qualifications.”

The Court granted TheLadders’ motion to dismiss claims of plaintiffs who were outside the statute of limitations, but the Court denied TheLadders motion to dismiss all the plaintiffs.

According to the complaint,

ladders4“From its inception until September, 2011, TheLadders scammed its customers into paying for its job board service by misrepresenting itself to be ‘a premium job site for only $100k+ jobs, and only $100k+ talent.’ In fact, TheLadders sold access to purported ‘$100k+’ job listings that (1) did not exist, (2) did not pay $100k+, and/or (3) were not authorized to be posted on TheLadders by the employers.”

In 2011, TheLadders stopped its “Only $100K+ jobs” advertisements (see Running On Empty: TheLadders folds up its shell game).

The Court ruled that the plaintiff “has sufficiently pleaded a claim that the defendant breached the June 2010 Terms of Use.” The Court also ruled that facts pleaded by the plaintiffs “give rise to a plausible inference that the allegedly deceptive transaction occurred in New York,” and that the plaintiffs have standing to assert claims under the law.

The long-awaited class action lawsuit against TheLadders for breach of contract and deceptive acts or practices may now move forward in federal court.


Unrelated to the case, employers have also alleged that TheLadders misrepresents salaries. In a 2011 Ask The Headhunter column (also reported on ERE.net) a recruiter at Royal Dutch Shell said that TheLadders scraped low-paying jobs from Shell’s website without Shell’s knowledge and pawned them off on TheLadders customers as higher-paying jobs. The recruiter said that the job applicants blamed Shell when they appeared for interviews only to learn the jobs paid salaries nowhere near what TheLadders represented. Referring to the overhead cost of interviewing inappropriate applicants channeled through TheLadders, the Shell recruiter said, “I’d love to charge them [TheLadders] for the amount of my time they wasted.”

The excerpt below is from a newsletter written by then-CEO of TheLadders Marc Cenedella — who pitched a feature of his service that the Shell recruiter gave the lie to just a few months later:

In June, 2011 Cenedella announced a new service — “A job offer. Guaranteed. Or your money back” for $2,495 — which included a new resume and an “advisor.” One month later, TheLadders announced cut-rate prices for all job seekers.

In a few short years, TheLadders went from “exclusive” and “Only $100K+”, and from offering resume services priced at $2,495, to “hardly exclusive” — and today there is no indication on TheLadders website that it offers resume services or guarantees of any kind. Today it’s just another job board, mired in costly litigation with angry customers who have been complaining about TheLadders questionable practices for years — customers who are finally getting their day in court.

Today, Marc Cenedella is Executive Chairman of TheLadders and CEO of Knozen.com, an under-construction website that’s taking names of people who want to be notified when the site is working.

TheLadders Update: Still sliming its customers

I’ve covered the sad story of TheLadders in many columns on this blog over the years. So, what’s up with this poster child of bad behavior in the career space?

  • The company’s $2,500 “We guarantee you a job” offer is long gone.
  • The front-and-center resume writing offers have disappeared.
  • Of course, a class-action suit about TheLadders’ misrepresentations about “ONLY $100K+ JOBS! ONLY $100K CANDIDATES” eliminated that ad campaign.

ladders3TheLadders’ home page used to feature links to all sorts of assets for job hunters and employers. Good, free content is how any online business succeeds today. There’s nothing on TheLadders home page to suggest there’s anything of value for anyone.

TheLadders website is now a dismal collection of five links that drive you straight to a data collection form and a subscription page. TheLadders doesn’t even pretend any more. It’s site is 100% carny-barker sales pitch, and that’s an insult to carny barkers.

There’s been nothing worth reporting or writing about TheLadders.

But a comment today on an early-2013 story I published, TheLadders sued for multiple scams in U.S. District Court class action, reveals that consumers should stay worried, and so should the courts. Nothing has really changed with this company’s M.O.

TheLadders is still all about parting you from your money by advertising non-existent jobs. I’ll let reader Steve C tell it:

I subscribed to TheLadders.com in mid June 2013 to apply for a single job which I was led to believe was exclusive to TheLadders. I found a marketing job posted on TheLadders. Although I was able to figure out that the job was with Husky due to some of the language in the posting. However I could not find that job on Husky’s website to apply directly. When I clicked on apply from TheLadders.com, it took me to their payment page. Since I was really interested in that job I decided to sign up for their best deal, a 3 month plan. After subscribing I clicked the apply link and the fraudsters at TheLadders redirect me to Husky’s website, where, you guessed it, job was long ago expired. I emailed TheLadders my concerns and basically it was an “eat crow” moment. Although their subscribe page led me to believe that this was an exclusive job, their agent “Timmothy S.” said that it was not exclusive and that it must have just expired. I promptly turned off the subscription auto renewal.

I will say that generally their email advice is OK but it is free anyway. At the time TheLadders were no longer promising that all jobs were above $100k, but they were still claiming exclusive high paying jobs. They are a scam and I would not recommend them. Use their free subscription and the google the job description to find the job. You can also look to see who the recruiters are that pull your profile and the connect with the recruiter via LinkedIn.

I have one piece of advice for Steve C: Don’t just turn off auto-renewal. Contact your credit card company to make sure TheLadders does not keep dinging your account for the subscription fee. You wouldn’t be the first “member” who cancelled and found — months later — that fees will still being charged to your card. “Oops,” says TheLadders.

What’s most telling about this story is the statement of the customer service rep: He admitted that the job posting “was not exclusive” and that “it must have just expired.”

It seems TheLadders customer service reps are still sliming their customers, reading from the same script that TheLadders’ customer Alishia reported in TheLadders: Job-board salary fraud? In essence, “Whoops!” and “Not our fault.”

Give us all a break, Marc Cenedalla. Pack it in.

Outplacement Or Door Number 2?

In the November 12, 2013 Ask The Headhunter Newsletter, a reader asks about outplacement:

My company is downsizing and I know I’m going to get cut. HR tells us they’re going to give us help finding a job from a top firm that specializes in this. What do you think of outplacement?

Nick’s Reply

When you get fired, outplacement is often the consolation prize. The employer spends 10 or 15 grand to help the employee “transition” (that’s used as a verb, so help me) and the gullible departee is grateful that someone is going to find her a job.

door-no-2Now read my lips: Outplacement might extend your unemployment rather than help you land a new job. So take ownership of your status, and maybe put some extra cash in your pocket. Here’s how.

Some years ago, when AT&T was doing a big downsizing, I got a call asking if I’d like to help with outplacement. I explained that I don’t scale — I can’t coach 5,000 people into new jobs because I don’t think anyone can do that. No, no, no, they said — you’ll be working with just a handful of managers who really need your help. So I took the gig.

The handful of managers comprised the career development team — that branch of the human resources department responsible for outsourcing “transition assistance” for 14,000 employees to a bunch of huge outplacement firms at a cost of $15,000 per person.

But the career development team didn’t want to go sit in cubicles with thousands of other newly minted job hunters. They wanted something better. They wanted highly customized help. Now, this was a huge feather in my cap. I represented “something better,” and I was proud of it. I did a good job helping every single one of them land in new jobs, and I got paid well.

But the point of this story is that the HR exec who hired me explained that outplacement isn’t so much for the departing employee. It’s mostly for the legal protection of the employer. I’ll over-dramatize how it plays out in court:

Downsized employee: “Your Honor, after 20 years on the job, they cast me out on the street!”

Judge: “Did they give you expensive outplacement services to help you find a new job?”

Employee: “Well, yes. They spent 15 grand on Transition Gurus, Inc. to help me, but they never found me a job.”

Judge: “Fifteen grand on a big-name company like Transition Gurus?! Why, they gave you the best! No matter that it didn’t work. No company ever got sued successfully for retaining Transition Gurus, Inc. Case closed! Next!”

While there are some boutique outplacement firms that do good work, the outplacement industry is dominated by a few big players that process the downsized like cattle. Make sure you know what you’re getting into.

Here’s how big-time outplacement often “works”:

  1. You don’t choose the outplacement firm or the counselor you work with. Your employer does. So from the start, you’re in the back seat of this adventure.
  2. The outplacement firm works for your employer, not for you. The firm’s job is to get you out of your employer’s hair, keep you busy, and make you feel like someone’s going to get you a job so you won’t sue your employer for wrongful termination. Outplacement is mostly about the company’s liability, not your future.
  3. Outplacement firms earn more money when you don’t find a job. Say what? Just what I said. Some of these firms drag out the process to milk the client for more fees, and to make it look like their “process” is thorough. Many programs are boilerplate presentations conducted by lightweight trainers. In some cases, they’ll talk you into buying “premium” services with your own cash.
  4. While you try hard to swallow the drivel some greenhorn counselor is feeding you (after all, you really do need help…) months drift by and your status deteriorates due to protracted unemployment. The firm looks busy, while you look like damaged goods.

Outplacement might be helpful, but never forget that you are responsible for your next career step. Don’t be lulled into thinking that a high-priced consultant — who works for your former employer — has any real skin in your future. The skin is yours alone.

Some employers are willing to give you cash in lieu of outplacement services if you ask. (You might have to sign release to get it. Talk to your lawyer.) It might be the best deal, and it might help you get into high job-hunting gear faster. If you decide to spend the money on outplacement with a good small firm, that’s up to you — you get to choose the firm and the counselor. If you use the money to tide you over while you conduct your own job search, that’s also up to you. I’d take Door Number 2: Go for the cash.

LinkedIn For Kids: The biggest lead-gen pimp on the Internet?

reidhoffmanWhat’s LinkedIn chairman Reid Hoffman looking at? 13-year-olds — LinkedIn’s newest big-money data set. And my bet is his sharedholders are going to be looking at the Internet’s biggest privacy nightmare yet.

Advice to Moms and Dads: Take your kids off his street.

Under the guise of helping 13-year-olds “start their careers off right,” LinkedIn is launching a massive initiative to tap the $300 billion teen market — selling advertising and selling access to kids’ data.

Ever since LinkedIn went public, it abandoned its mission to be the world’s biggest and best professional network. It has quickly evolved into an advertising business.

With a hot IPO behind it, LinkedIn’s management team rushed head-long into silly commercialization, betting that its public relations campaigns could keep its reputation afloat — while the company furiously drained all the integrity out of its ever-growing pool of users.

First, LinkedIn ejected its team of salaried relationship-builders and brought in a boiler room full of telemarketers working on stiff quotas. According to SEC filings, in short order LinkedIn’s sales and marketing operation skyrocketed from 207 people to 1,822. LinkedIn founder Reid Hoffman and CEO Jeff Weiner realized that their company’s value wasn’t in the business networks it had created. The big money was in keywords. So they started selling members’ data to employers, just like Monster.com and CareerBuilder do.

Just another job board

LinkedIn launched its IPO, and re-launched itself as a job board. Chucking connections for cash, LinkedIn has been charging job seekers for “Premium” services. (See Is LinkedIn Cheating Employers and Job Seekers Alike?) For $29.95/month, you can buy empty promises of status and top position on the list of resumes employers pay to access. (You also get to write a dozen or so “InMails” using LinkedIn’s cumbersome, proprietary mail system that tracks who you communicate with.)

linkedinbuttonWith a wink and a nod, LinkedIn cautions members to apply only for jobs they are truly qualified for — but gave them a button to easily and instantly apply for any job they encountered. Like the job boards, LinkedIn is facilitating a jobs lottery: The more tickets you buy, the more chances you have to win!

And as LinkedIn members started flooding employers with applications, employers paid LinkedIn to drink out of a fire hose.

But, everyone knows that job boards aren’t just in the job board business. They’re in the lead-generation business. Your “profile” is chock full of incredibly valuable information to salesmen and marketers. If you don’t believe me, just create a faux membership on any job board using a faux e-mail address and watch your in-box to see who’s buying or renting your data.

Hacking Members’ E-mail: The new business model?

If anyone thinks LinkedIn is in the “relationship” and “professional networking” business, listen closely: LinkedIn is an advertising company collecting data to linkedin-hacksell. At LinkedIn, “innovation” means “We make more cash from your data.” And members don’t like it. They’re complaining that LinkedIn hacked their external e-mail directories and — without permission — is sending solicitations to their contacts. Last week, a group of LinkedIn members filed a class action about this practice in San Jose federal court. (The New York Times says “the company is treading dangerously.”)

Hoffman and Weiner have found the Holy Revenue Model: Charge everyone, and convince everyone this is the only game in town!

Gone are some of the most useful services that LinkedIn used to offer to members. The company killed LinkedIn Answers, a powerful way to network and share information — and introduced a service its users find laughable: Endorsements — the equivalent of cheap come-on lines thrown at girls in bars.

Then LinkedIn itself started courting girls and boys — 13 and older, just two weeks after issuing $1 billion in new stock. Now kids can connect with adults. What’s going on here is obvious. LinkedIn is scrambling to acquire more personal data, from yet another valuable demographic, to prop up its stock price.

Hey, little girl…

In what must be the most laughable bit of bullshit published online this year, LinkedIn’s Eric Heath announced that kids are invited to join LinkedIn “so they can make the most informed decisions and start their careers off right.”

free-candy-vanGimme a break. This new “age of consent policy” has nothing to do with 13-year-olds’ “careers” and everything to do with collecting personal data.

LinkedIn’s intentions and motivations are obvious. Reid Hoffman is driving around the Internet offering memberships to a demographic that spends $200-$300 billion annually (teenagers) — and that’s just in the United States. Hey, little girl… how about a nice piece of e-candy…?

This is all about personal data for sale

LinkedIn is now all about advertising. To monetize the 13-year-old data set — and your profile, too — the company just hired Groupon ad exec Penry Price, signaling that “connections” are the bait, and that the real name of this game is advertising.

Has LinkedIn become the biggest lead-gen pimp on the Internet — now featuring kids, their personal data, and their money? Moms and dads can start sweating bullets, too, wondering who’s protecting their little girls’ and boys’ information.

But stockholders can rejoice, at least for now, because everybody pays the house. As litigation mounts, Hoffman and Weiner may find they’re going to pay the piper.

Executive Search: Don’t pay lazy headhunters

In the September 17, 2013 Ask The Headhunter Newsletter, a reader asks why headhunters charge you to join their database so they can “find” you and earn big fees by placing you. Where’s the search in that?

I run a small, high-tech company and I’ve been looking at various models for hiring top-level executive talent, and also in case I decide to look for a new executive job myself. What’s your quick take on the BlueSteps Executive Search service that I keep seeing advertised? I know you say the candidate should never be paying to find a job. BlueSteps charges executive job seekers $329 to join its database. Is it the same story here? I thought headhunters got paid big fees to go find people — not to charge me to join the database they search.

Nick’s Reply

You nailed it. The candidate should never pay a dime to find a job — especially when a corporation is paying a big-name “executive search firm” huge fees to find the right candidates. (Real headhunters go out and find good candidates; they don’t charge candidates to be found.)

payoffWhat is it, anyway, with this new “business model” online? Create a database, charge job seekers to add their information, then charge employers (or headhunters) to find the information. Everybody pays! And the entrepreneurs doing business this way come off like slimeballs. Great business model!

We’ve discussed TheLadders, CareerBuilder, LinkedIn, and other job boards that charge job seekers — and then charge employers. (You should never pay for access to jobs — or to headhunters.)

Now there’s a new player in this league. BlueSteps — an operation of the Association of Executive Search Consultants (AESC). It’s doing what LinkedIn does: tapping job seekers for fees. It’s a racket.

Then the executive search firms that belong to BlueSteps charge their clients — corporate employers — one-third of a new hire’s salary to fill executive positions. We’re talking $100,000+ fees.

What makes these search firms worth so much? It’s a good question, because according to BlueSteps’ website, (1) they fill jobs by surfing a resume database, and (2) they deliver job seekers who paid to join the database. That’s not worth $100,000.

Real executive headhunters don’t sit in front of a screen reading resumes that come across the BlueSteps — or any other — database. They actually go out into the world and hunt the people their clients need. They travel in their professional community. They go where top talent hangs out and mix it up. They talk to respected members of the executive community and form long-term relationships. They track down talent that is hidden or unknown to their clients and bring it home.

lazy_recruiterWhen headhunters find their candidates in a database that job seekers pay to join, something smells. This is not headhunting.

Consider: BlueSteps is an association of search firms that get paid in the vicinity of $200,000 to fill a $600,000 job (one-third of the new hire’s salary). So, why is the AESC charging people to put their resumes into a database that its members can then query to find candidates? It rightfully raises an alarm. Suddenly, executive search is not worth $200,000. Any employer’s own personnel jockeys can surf databases to find people at any salary level. The same executives that populate the BlueSteps database are in other databases, like LinkedIn.

The suckers here are not just executives who pay $329 to “join” the BlueSteps database. The really big suckers are corporations that pay exorbitant fees to lazy headhunters who while away their hours feeding at the database trough.

Check this testimonial on the BlueSteps website from a managing partner at a world-class executive search firm:

“BlueSteps is a very effective way of being visible to the retained search community, as its database is constantly mined by AESC member firms.”

Mined?? Why aren’t these lazy headhunters out actually finding top executive talent? Why are they relying on job seekers who paid to get into the database?

Another managing partner (Don’t you love that title?) at another executive search firm testifies:

“Through BlueSteps, we quickly located three of our top candidates located in a broad geographic cross-section including Los Angeles, New York City, St. Louis and London. The candidate signed on for a total compensation package of $500,000+.”

This headhunter collected a fee that was probably around $166,000 — for querying a database. This is not executive search. This is lazy. This is a racket.

BlueSteps says that “in the past 90 days 3,549 BlueSteps database searches [were conducted] by executive recruiters,” and that executive profiles in the BlueSteps database were viewed 12,732 times.

What those managing directors are saying is, We no longer conduct the searches we’re being paid to conduct. We search databases, just like you do — and we charge you $200,000 to fill your open job the way your own personnel jockeys do it.

So, now that we’ve dissected this silly proposition, let’s get to my advice.

If you need to hire an executive, and you have a $200,000 budget to pay a headhunter, go to a small boutique search firm that actually has good contacts in your industry. Use a headhunter who flies below the radar, and who will go out and meet, talk with, and cultivate the best industry sources to get credible, trusted referrals to the best candidates. These are often solo practitioners who are highly respected in the industries they hunt in — headhunters who have relationships that yield excellent referrals. They don’t need LinkedIn, and they don’t need BlueSteps. They make their money the old-fashioned way: They earn it. (You can learn How to Work With Headhunters… and how to make [real] headhunters work for you.) They invest in people and in relationships — not in cheap recruiting tricks. And they get off their butts and actually recruit.

But if you want candidates from a database that people pay to join, then try BlueSteps.

Or, if you have $200,000 to spend and you’re smart, my guess is you could fill the job yourself. And that’s the lesson here. Filling top jobs properly, by finding the best people, is hard work, but it’s not rocket science. It’s just astonishing that AESC and BlueSteps and their members, who call themselves “executive search” firms, conduct “searches” by surfing databases, and by charging job seekers fees “to be found.”

That’s not worth $200,000. Or even $329. Don’t pay lazy headhunters.
