Bob Cialdini has spent his life studying the parameters of compliance — how we get others to do what we want. And that’s exactly what you need to know to get an employer to hire you.

If you don’t listen to another podcast this year, listen to Dr. Robert Cialdini’s clear, compelling conversation with Guy Kawasaki about how to ethically influence other people to “come in your direction.” Gene Webb, my mentor at the Stanford Business School, gave me Cialdini’s book, Influence: The Psychology of Persuasion, while I was a graduate student. I’ve since given the book to my own kids and to many friends.

Robert Cialdini is professor emeritus at Arizona State University and one of the world’s leading researchers in social psychology. He’s probably also the most widely read psychologist in the sphere of sales. But don’t let any of that put you off. This isn’t armchair psychology or cheesy sales training. In the November 26, 2019 Ask The Headhunter Newsletter a reader questions the value of a credit report when judging a job applicant.

Question

credit reportIs a credit report from the big three credit reporting agencies (e.g., Experian) a good proxy for determining if a job candidate would be a security risk? Should a candidate be given the opportunity to explain and provide background about any items on a credit report that may appear as a negative to a potential employer? Or, should the credit check stand as a pass/fail test that a potential employer uses to determine if a candidate might be a security risk?

Nick’s Reply

You’re not asking how to avoid getting rejected for a job because of your credit report, but whether I think this would be justified or wise on the part of employers. We’ll stick to the topic here. If there’s enough interest, we can tackle the “how to” another time.

While we might make a case for employers doing credit checks on job applicants, it makes no sense to me why employers rely on such information to judge whether an applicant might be a security risk — especially not on a pass/fail basis. I haven’t seen any statistics on the actual correlation, much less any suggestion that credit records predict security worthiness. (If someone’s got statistics, please share in the comments section below.) The real risk to the employer is that it loses an otherwise excellent candidate to an assumption that credit behavior correlates with job performance and security worthiness.

Does a bad credit report make you a bad hire?

It might seem silly to make the comparison, but do we reject applicants who’ve been divorced because they are more likely to be bad business partners? Do we reject software developers because they don’t do proper maintenance on their cars? What about people with disabilities? Are they risky hires? Oops. The law protects them. Do you see where I’m going? I think employers should stick first to judgments about whether a candidate can do the job effectively, and second whether they fit the social norms of the organization.

In the U.S. there are laws that govern the use of credit checks on job applicants. Of course, these vary by state. I like Alison Doyle’s rundown on job applicant credit checks.
The challenge is how to assess those characteristics. While I’m not opposed to psychological testing and correlational evidence to make judgments like these, I think HR departments screwed the pooch long ago when they deftly transferred liability for hiring judgments to tests and indirect metrics of character. I believe this is a huge cause of HR’s “talent shortage” problem. These indirect assessment methods cost employers good hires. (See Big Data, Big Problems for Job Seekers?)

Employers need to teach hiring managers how to make better assessments and judgments of candidates directly and personally. It’s an interview skill. But how many companies teach interview skills?

Is your credit report a valid and reliable metric?

I agree that, if a credit check is to be done, the applicant should be allowed to explain the report – but that opens another legal can of worms. The applicant could potentially sue the employer for rejection based on misinterpreting the information. This, of course, is why the employer might use a credit report as a pass/fail metric without disclosing it to you. (For more about this, read my good buddy Suzanne Lucas’s warning to employers, If You Run Credit Checks on Your Job Candidates, Now Would Be A Good Time To Panic.)

Is there any defensible reason for basing a hiring decision on such a data point? It’s hard to make the case that it’s valid except as an indication of credit worthiness (and even that can be questionable). It’s worth looking up “validity” and “reliability” in the context of making assessments. Does a credit check really measure what you need to measure?

Employers have explaining to do

Here’s how I think I prove my point. I’ve never heard of an employee being terminated because the employer checked their credit report. If credit checks are such valid and reliable indicators of security worthiness (or any other job-related requirement), why don’t employers run reports on all employees annually to decide whom to terminate? I think HR has a lot of explaining to do.

Employers try too hard to offload candidate assessment to indirect metrics, and they do a lousy job of justifying themselves. In most companies, it seems HR’s first objective is to offload liability. I think the better practice is for employers to make their interviewing and reference checking more rigorous. To avoid unreasonable risk, make managers very good at interviewing and judging job applicants.

My snarky suggestion to job seekers is to ask a snarky but justified question if an employer brings up a credit check. “Can you show me empirical evidence that my credit report is a valid and reliable metric for judging me as a worthy hire?”

You’d be surprised how many successful people I’ve placed who had questionable “background checks.” It takes a lot more to really judge someone – or you miss some great candidates!

Behind the scenes of a rescinded job offer

In the September 25, 2018 Ask The Headhunter Newsletter an HR worker reveals how a faulty HR process led to a job offer being rescinded after the applicant quit his old job.

Question

rescindedI work in Human Resources (HR). During our on-boarding process, we send prospective employees for a drug screen and run a background investigation and, if the job requires driving, a motor vehicle record (MVR) check. The background is launched when the applicant electronically completes an authorization.

We had planned on hiring a guy, when three days before his start date he had still not signed the authorization. So I ran the part of the background that I already had authorization for, and saw that his MVR was horrible. He had DUIs, super-speeder violations and more.

He’s already given his notice to his old employer, and we can’t hire him. I think he avoided signing the background authorization to hide a bad record.

We had to rescind the position as we don’t have any positions for a non-driver. I feel bad about this but I also think he should take some of the responsibility. What do you think?

Nick’s Reply

It’s important to consider the critical path of your company’s hiring process. That is, which steps are critically dependent on earlier steps being completed satisfactorily? And, who is responsible for those?

The critical path to making a hire

You don’t say explicitly whether you made this applicant a bona fide job offer. But I think it’s fair to assume you did based on two other pieces of information you shared.

  • You started the on-boarding process. You would not have done that without two critical steps being completed first. You had to extend a job offer and he had to accept it.
  • He quit his old job. He would not have taken that critical step unless the two aforementioned critical actions were taken first — an offer was tendered and accepted.

Please note that I’m not putting any specific order on these critical steps, though of course there is a necessary order. In any case, when you made that job offer and it was accepted, you had a contract. The deal was done.

A job offer is a contract

So, where does that leave your company and the HR person who is responsible for the hiring process? In a bad, indefensible spot, I think. You made and broke an agreement. A rescinded job offer is a broken contract.

Two other critical steps in this hiring path are:

  • Obtaining authorization to conduct a background investigation.
  • Conducting the investigation.

Clearly, both of these critical steps must be done before you can hire anyone. And the investigation — a critical step — brought the entire process to a screeching halt when you discovered the problems, as it should. That’s why that step is on the critical path to hiring, right?

Where you blew it is that you apparently jumped ahead. You made an offer — a contract — before obtaining authorization to do the background check, and before you had any investigation results. You acted without due diligence.

Why would any employer do that?

Due Diligence: Don’t take a job without it.

The applicant’s mistake is that he followed your lead. He, too, failed to perform due diligence to ensure your company was acting in good faith. He didn’t double-check to make sure you had followed your own critical path before he took the ultimate critical step: He quit his job.

Why would any job applicant do that?

No job applicant can afford to quit their old job, or to trust an employer or HR rep, unless they are certain they have a bona fide job offer.

A bona fide job offer

A job offer is bona fide when it is:

  • Neither specious nor counterfeit; genuine
  • Made with earnest intent; sincere
  • Made in good faith without fraud or deceit

You, as an HR representative, know your company cannot hire someone with a bad record. So, why did you make a job offer before checking? There’s no good faith when you lead someone to quit a job so they can start work with you — then pull the rug out from under them. A rescinded offer is a broken contract

You said: “We had to rescind the position as we don’t have any positions for a non-driver.”

That’s not why you rescinded the offer. You rescinded because you didn’t do your job properly. The main fault is yours, and it could get your company sued. (For an attorney’s take on this, see Job offer rescinded after I quit my old job.)

You should never have made an offer before you conducted the investigation. The investigation came first on the critical path to making an offer, before the hire quit his other job, and before you began on-boarding the new hire.

Hire with integrity

A company should hire with integrity. It should follow a sound process that ensures a healthy deal will be struck that is good for both parties. That requires following a series of steps in proper order, to protect both parties. (See Protect yourself from exploding job offers.)

Here’s the critical path you should follow. Staple it to your office wall where you can see it all the time. Make sure everyone involved sees it in advance and signs off at each step. None of these steps should be taken until all previous ones have been completed:

  1. Make sure the position is open and fully funded with an appropriate salary and benefits.
  2. Conduct interviews.
  3. Decide your favored applicant is qualified and that you want to hire them.
  4. Conduct appropriate background investigation(s) after obtaining authorizations.
  5. Confirm that all information you need about the candidate has been gathered and logged.
  6. Make a bona fide offer in writing that includes all terms, signed by an authorized representative of the company.
  7. Confirm the candidate’s bona fide acceptance of the offer and terms in writing.
  8. Notify the candidate that the hire is confirmed and that they should resign their old job.
  9. Conduct your on-boarding process.
  10. New hire starts work.

The applicant was foolish to accept a job offer before confirming that your company’s critical path had been completed. He was disingenuous about not signing the authorization for the background investigation. He was downright stupid to quit his old job before ensuring the new job was solid.

So he, too, bears responsibility. Caveat emptor. But shame on you as the employer for letting the matter get to a point where you had to rescind the job offer.

The employer owns the hiring process

Your company is going to spend money to hire someone. You start the ball rolling and control the process. You own the process.

It doesn’t matter if your investigations reveal the candidate is an axe murderer. It’s still not his fault that you didn’t do your job prior to issuing a job offer. You failed to conduct due diligence (the checks and investigations). In this case, your process should have stopped dead at step (4.) above.

You tacitly if not explicitly encouraged him to quit his job and relinquish his pay based on your assurance (the job offer you gave him) that he could rely on you to hire him. No one deserves that. (If he’s an axe murderer and you don’t figure it out prior to making him an offer, then shame on you.)

Rescinding a job is not an option

Please review the 10 steps in the list above. Nowhere is there a “Rescind job offer” step. It’s a terribly embarrassing option. Rescinding a job offer is a last resort that you — and your company — will pay for with your reputations.

You need to sit down with your top management to develop a critical path to follow when hiring. The fact that you were three days from his start date when you figured all this out reveals a shocking problem at your company. (See Smart Hiring: A manager who respects applicants (Part 1).)

Rescinding a job offer that your company never should have made is unacceptable.

Weird Tales of Job Offers: The new hire who disappeared

In the July 17, 2018 Ask The Headhunter Newsletter an employer tells about a disappearing employee and we share stories about job offers.

I’ll bet you have some interesting job-offer stories. Here’s one I’d like to share.

job offersWe had a candidate go through the interview process and the offer cycle at our company. He took a position for a week, then returned to his other job. He never gave notice to his other employer, just took vacation time. After working the week, he didn’t return. It took a couple of days to track him down at his old work number. Is this common?

Nick’s Reply

I don’t think it’s very common simply because it’s the stuff bad reputations and terrible references are made of. Disappearing from a new job reveals a profound lack of self-confidence on the part of the candidate (not to mention integrity). This is a person who needs a safety net, and who will not invest himself in a new job enough to succeed. (Relationship counselors refer to this as “commitment phobia.”) He probably needs a back-door out of all the important choices he makes. In the end, the result is almost inevitable. People like this never find job offers that make them happy because they don’t commit. They keep going back to the devils they know rather than figure out how to move on with their lives. (See Should I just quit, or find a new job first?)

Don’t give this guy another thought. Move on to better candidates.

I do indeed have a lot of interesting stories about job offers. There is a mini-lesson in each of them. Let’s look at a couple of the characters I’ve encountered.

The guy who accepted lots of job offers all at the same time

He was a design engineer, and since engineers tend to keep odd hours and schedules, he was able to pull it off without much difficulty. I do give him credit for working very hard. He apparently was able to deliver the work required at each job. (Maybe this should tell us something about employment!) This man of multiple salaries accepted new job offers every few months without discarding all his old jobs.

He was able to jack up his salary enormously within a couple of years. While some job hunters don’t like to show their old pay stubs, he took great joy in it, and used proof of his current salary (one of them, any way) to gain small increases wherever he could. Lots of small increases add up!

He was quite proud of himself. I’ll never forget his smirk when I found him out. He suggested that I could earn multiple placement fees in short order by cooperating with him. I shared the story with many clients — along with his name.

The guy who used a job offer to extort a raise

He had two weeks to consider a job offer, and on day 14 asked for another week because he “wasn’t ready.” I got him an extension, but I could smell it coming.

A week later, he still wasn’t ready. I told him he had 24 hours to make a decision. My client wouldn’t wait any longer. Within the hour, he called back, frantic. “I accept the job! But I must start today!”

Turns out he had two problems. His intention all along was to use the new offer to leverage a raise, but he lacked the confidence. He was terrified to go dangle the new offer in front of his boss — thus the three wasted weeks. When I issued my ultimatum, he sheepishly approached his boss. During the “negotiation,” his boss had a security guard usher him out the door. (See Naïve young grad blows it for a discussion about using a new job offer to leverage a raise.)

His other problem: His wife threatened to leave him if he was out of work just one day. Thus his hurry. I followed his career for several years. I think few men have learned a lesson so well as he did.

I’ll let you draw your own lessons from these stories, whether you’re an employer, a job hunter, or a headhunter. But remember G.K. Chesterton’s words: “There is no man really clever who has not found that he is stupid.”

How To Hire: 8 stunning tips

In the June 6, 2017 Ask The Headhunter Newsletter, a manager offers 8 stunningly clear tips about how to hire so effectively that other managers in your company steal your hires.

A hiring manager who prefers to remain anonymous teaches us how to hire. This should be required reading in every company. There’s nothing for me to add except Thank you.

Most of my colleagues do not know how to interview anyone. They rely on rules of thumb, guts, or chicken entrails.

Actually, they have their direct reports interview the candidate and then vote on the candidate. I have a different way to hire and I think it works.

1. Recruit all the time

Always be in interview mode. Talk to prospective candidates even if you don’t have a place for them. (See The manager’s #1 job.)

2. Don’t hire by consensus

Do not allow your team to vote on candidates. The hiring manager hires. People are tribal and will pick people like themselves. Do not have a team where everyone is the same.

3. Start with all the resumes

Tell HR to send you all the resumes. Don’t let anyone edit your selection because they’re not as qualified as you are to judge the applicants. If you know what you want, you can go through them much faster than an HR clerk. (See also Sorting Resumes: A strategic hiring error and Why HR should get out of the hiring business.)

4. Hire the dancers

Don’t hire anyone for whom the job is a lateral move. That’s what contractors are for. You want people for whom the job will make a difference in their lives. You want your new hires to dance to work.

5. Interview wisely

Interview only 5 candidates to prevent interview fatigue. Schedule interviews over a 3-4 week period and make a decision within 24 hours of the final interview. (Use the phone only to confirm availability. Phone interviews are nearly worthless.)

6. Can they do the job?

Ask candidates to audition for the job. Give them a simple assignment before the interview. (See What is the single best interview question ever?)

7. Act responsibly

Write to every candidate after the interview and give them your results. It is common decency. Besides, you may want to hire the second best candidate in a few months.

8. Get better at hiring

Last, review your process and look for improvements.

The problem with hiring this way is that the people you hire are so good that other departments will poach them. But that’s really okay, because you want to bring motivated people into your organization. Be proud of the impact your hires make.

Like I said, this is so good that there’s nothing for me to add. What I think would be incredibly productive is to hear from this community — from hiring managers, job seekers and HR folks — about how you would flesh these 8 suggestions out.

Update

Number of interviews

After this column was published, a good question was raised by readers (in the comments section below) about whether the manager (whose advice this column is based on) really means you should interview only 5 candidates in total, and how long the entire process should really take. So I asked him. Here’s his reply.

Scheduling a series of interviews with the internal stakeholders is not easy. You don’t want a candidate to return to the office multiple times to interview. Placing a line in the sand is for the benefit of the internal stakeholders telling them you will finish this task in 3 weeks. I have had SVP’s insist on interviewing a potential hire and then have their schedule full of meetings for the next 2 weeks. I have also had other managers want to interview a candidate to determine if they are good fit for their team.

I stop at 5 candidates because of interview fatigue. The candidates start to blur over time and they become difficult to compare. The interviews are at least ½ day and the cost to the team in lost work starts to show. If you try to interview 5 candidates in a week your team will not be able to get any work finished.

Also, at least 2 candidates will be from professional conferences or prior interviews. They are already known to the team and just have to run the HR gauntlet.

Salary

The hiring manager also explains how he handles the salary question during interviews.

I never ask the candidates current salary because I feel it is irrelevant.  I know the market clearing price and most of the time the candidate knows it.  The ones who don’t know it are HR and that’s where the struggle begins and ends.  That’s why it will sometimes take weeks to schedule an interview.  You don’t want to bring anyone in until HR agrees with you on the salary range.

I had one hire who told me that his new salary was 100% higher than his previous salary.   That was a person who danced to work every day.
