Big Brother & The Employment Industry: “All your employment are belong to us!”

Suppose that every time you applied for a job, some guy in a little room checked an Excel spreadsheet and notified the employer: “No interview for this guy. He’s a bum.”

It’s already happening.

Several years ago I published a series of articles about identity theft via job boards, including a report about Monster.com’s troubling practices by Pam Dixon from the World Privacy Forum (Click, You’re Hired. Or Tracked). Later, I published a newsletter titled Does HR go too far when screening candidates? in which HR consultant Earl Rice warned that:

“…in their zeal to protect themselves and their companies, HR departments may be covering up illegitimate and possibly illegal practices. When HR outsources background checks and investigations of candidates, is HR doing its job, or is it ensuring plausible deniability while letting loose an investigative demon that systematically violates people’s privacy and feeds the specter of identify theft?”

Trading privacy for Big Brother’s social initiative

It’s a world where Facebook routinely collects and profits from massive amounts of personal information. It’s a world where people enjoy the benefits of “social networking” and just want to keep up with their friends minute-by-minute. It’s a world where Big Brother has taught people to shrug and say, “Privacy? There’s no privacy any more. My information is in lots of databases and it’s not worth worrying about it!”

It’s a world where corporate employers are covering their legal asses while you get rejected for jobs that have long been vacant because “there’s a talent shortage.”

It’s also a world where opening a financial account in your name doesn’t take much more than your name, address, social security number (SSN), and a signature — any signature. But in today’s economy, the permissions you grant to employers when you apply for a job can continue to cost you lots of jobs — and you’ll never know it.

Let’s go back to what HR consultant Rice said back in 2003:

“If you have signed one disclosure for one employer, the investigations company that did the checks will keep the information about you in their database and then just re-sell the results to their next client.”

How does this happen? HR outsources the investigations, and the third party investigations company owns the information it gathers about you. The next employer rejects you for the same reasons the last one did. Were those reasons legit?

“This total invasion of privacy beyond your wildest dreams (actually, nightmares) is outsourced. The worst part is that much of the data and information these outsourced security agents collect is erroneous.”

You sacrifice privacy; employers buy legal protection

But while you’re giving up your privacy for certain “social” benefits (like the ability to apply for a job), employers are capitalizing on the holes you just punched in your life. Then, those same employers are buying legal protection in case you sue them for peeking through the holes. Rice reiterated that the quality of information about you in those databases isn’t the issue; insulation of employers from legal liability is the issue. Rice warned warned that an employer’s intentions could be far more complex:

“This is an industry that is almost totally unregulated. The multiple levels of outsourcing and subcontracting yield enough plausible deniability to the companies themselves,  and their clients, that abuses run rampant.”

Are employers using third parties to distance themselves from legal liability when checking you out? Who’s responsible for auditing and tracking the use and security of personal information an employer gathers about you?

Like many people, I put all this aside and chalked it up to Big Brother’s ubiquitous presence in our lives… the Internet, after all, is the Big Brother we’ve invited into our lives, choosing to accept the quirks of his behavior in exchange for all the social gifts he bears.

The little man who controls your career

That’s how I compartmentalized it all, until a reader sent me the story of his recent experience with a major American corporation with operations around the world. The reader is a 20-year veteran of the information technology field, and has more than a passing knowledge about security. Read it and decide how worthy a trade we’re making — some of our privacy, in exchange for the wonderful social gifts Big Brother delivers into our lives.

During Q4/2010, I was being considered for a position with [Company X]. Before I could be submitted for consideration to the hiring manager, the recruiting agency required my name and full SSN so that it could be checked against a database of Company X’s former employees. I decided to dig into their process.

Each agency was collecting names and SSNs within their offices in a spreadsheet, then submitting them periodically to a third-party agency via unencrypted e-mail attachment (Excel file). I went as far as to contact the individual at the third-party agency who was receiving and processing the queries.

He told me that he logged into a Company X mainframe application to enter the names and SSNs, then returned the spreadsheets to the agencies with a Yes or No indication for whether the candidates were acceptable to Company X on the basis of when and how they may have might have been terminated, or if his check could verify that they had never worked for Company X. He then combined each of the spreadsheets into one of his own so that he could independently track and verify the names and numbers he had already processed.

Me: “Where do you keep that spreadsheet?”

Him: “In my in-box in Outlook.”

Me: “Do you see any security risk in that?”

Him: “No, it’s just on my desktop.”

I was shocked.  That was when I decided to pass on the opportunity. I also informed the agency rep who had contacted me about the job that this was how it was being done, and while he agreed that it wasn’t very good, he had no way to change the process put in place by Company X.

All your career are belong to us

You worry that you’re too old, or that you lack the proper college degree or skills. But employers are rejecting you before they check any of your work credentials. Your career is subject to “judgments” far more stupid and unsophisticated than you could imagine — judgments that could well be incorrect, and over which you have no right of appeal.

In 1991, a poorly-translated warning appeared in a popular video game: “All your base are belong to us.” Today, the game ends for many job applicants before it even starts.  Your career belongs to the little man with the spreadsheet, who operates at legal arm’s length from the employer that rejected you. He works for an agency that is contracted by lots of employers to handle candidate investigations, and to notify employers whether you should be interviewed.

But, the business is not about hiring; it’s about selling and re-selling data about you whose accuracy you cannot confirm.

“The larger outsourced security/investigative companies have started keeping databases of their own. One advertises they have a database of over 1.5 million people for employers to run their candidates against.”

At the time Earl Rice contributed his commments to Ask The Headhunter, he was working for a major employer that outsourced background investigations to third parties that weren’t even in the United States. They were based in what we used to affectionately refer to as Iron Curtain Countries.

“They start with a name and phone number and e-mail address from a resume or application. Then, they cross-reference information until they get a date of birth or social security  number and go from there. When an applicant walks into HR for that first  meeting, they already may have been investigated. Never mind that much of the  data gathered may be erroneous. The ‘data’ was gathered at arm’s length, but the  employer will treat it as absolute fact.”

Advantage Employment Industry

Employers are ultimately responsible for the way job applicants are treated, no matter how carefully they’ve instituted legal protections by outsourcing candidate rejection. But the problem job hunters face is a systemic one. There’s an entire employment industry that now relies on Big Brother and the holes you permit in your personal privacy. Privacy expert Pam Dixon boils it down:

“The business of searching for jobs online has grown from a market niche to a multi-billion-dollar, rapidly consolidating industry that relies on the eager search activities — and employment dreams — of millions of job seekers.”

Every time a job hunter submits an application through the rote channels established by corporate HR departments, the employment industry gets paid — whether a match is made or not. The job hunter loses, and the hiring manager cries about the talent shortage. Employers give the advantage to the employment industry — a mafia of consultants and contractors who bear no responsibility, because they just manage that spreadsheet.

Every time a job hunter agrees to apply for a job via Big Brother methods, rather than through a personal contact with a hiring manager, the job hunter sets in motion the wheels of an entire data industry designed to make money — not to match people with jobs. Most of the time, the job hunter gets taken down in a drive-by data attack. The little man with the spreadsheet wears a hood, and even the employer has no idea who’s driving the data base. Or where the keys are.

The IT manager who shared the story above decided to skip the little middle man — and Big Brother. His next contact with an employer was direct, and he hasn’t submitted to a strip search of his personal information. His job search isn’t easy, but he still owns his career.

Hey, Babe, don’t I know you from somewhere?

In the October 4, 2011 Ask The Headhunter Newsletter, a job hunter asks whether social networks like LinkedIn are a great way to get a foot in the door when looking for a new employer.

I am currently looking at new job opportunities. Your suggestions are to network in order to find out more information about a company and to get to know the right people before you even think of trying to get a job there.

What is your view on making contact with people you don’t know at all via social networking sites, such as LinkedIn? I have joined some of the professional communities and this seems like a great way to make initial contact with people in a particular industry, but is this just a fake idea or is there actually some merit in this method?

My Advice

Getting to know a company through people connected to it is the best way to land the right job, and it’s the best way to avoid mistakes. But social networking sites portray this inaccurately. They show you a cool database of names and information, and they suggest that the links between people’s records constitute “your contacts.”

What’s a link?

That’s absurdly reductionist. It’s like suggesting that because your name sits alphabetically beside another, you share a “contact.” In the database, perhaps you do. But in real life, the fact that we both do business with a certain auto mechanic, or that the mechanic attended the same college we did, doesn’t hold any value. The only thing we share is a coincidence. To make that serendipitous “link” useful, one or both of us must invest a lot to create the shared experiences that lead to a relationship and friendship.

What are you going to do for me?

LinkedIn — like any other online social network — is just another social environment. Imagine walking up to someone at a friend’s party — someone you’ve never met — and asking them to recommend you to the president of their company. Other than the fact that you and the person “share a link” via the friend whose party you’re attending, there are no shared experiences between you. There’s no justification in asking for such a favor, and the person has no reason to trust your intentions. Even if the referral were made, the president of the company would not be able to obtain any useful judgments about you from the mutual contact, because there’s no basis for such judgments. There are no shared experiences. Just that serendipitous meeting.

That’s why you feel so awkward asking a favor of someone you don’t know who doesn’t know you.

The LinkedIn party is not much different. In both cases, the only way to make a real contact is to start a conversation on a legitimate topic you’re genuinely interested in. Use the normal rules of conversation. Invest in a real relationship that takes time to develop. But don’t expect someone who is “linked” to you in a database to feel any obligation to talk to you.

I found you in the phonebook

People construe the existence of a social network as permission to exploit nodes (people) when there’s no substance in the links between them. That is, they think that belonging to a huge list of people means those people should bend over backwards to help them. When help doesn’t come, LinkedIn turns a dumb expectation into a dumber process: Make more links until you get what you need!

LinkedIn is little more than a big phonebook. No one’s going to take your call just because you looked them up. It takes more. (See also: LinkedIn’s New Button: Instantly dumber job hunting & hiring.)

Take a hike

To answer your question, I think a social network is just one more list of people. So’s a phonebook, and I always hang up when someone calls me from a list. I also instantly delete e-mails that say, “I’d like to add you to my professional network on LinkedIn.” That’s the new “Hey, Babe, don’t I know you from somewhere?” and it’s just as presumptuous — and just as offensive.

LinkedIn is a nice directory. Social networks are the new phonebooks. How you make new friends who care about you, however, hasn’t changed. You still have to hang out with them and share experiences that matter.

Don’t be afraid of a C-level contact

In the September 27, 2011 Ask The Headhunter Newsletter, a job hunter says he’s got personal introductions to two C-level execs at a company where he wants to work. He worries, is it even a good idea to use them?

The CEO of my former company just gave me two of the best contacts that one could ever hope for. It turns out that he worked at the company in which I’m now interested. He gave me the direct numbers of the CEO and CIO there, and his permission to use his name liberally.

The problem is that I wouldn’t be reporting directly to either of these gentlemen. I technically fall under the CIO’s umbrella, but far removed — I want a web developer job that they have available.

Another problem is that I don’t know anyone else in this company of about 500 people. So how do I take advantage of these contacts without having the whole thing blow up in my face? Should I even try contacting them if they’re not going to be the ones to whom I’d be reporting? This might be as bad as trying to contact HR. Please advise.

My Advice

The best thing you could do is ask your CEO buddy to call one of these people and recommend you. This is very powerful. If your old friend thinks so much of you, he should be willing to make the call.

Alternately, you could call the CIO, since that’s the area you’d be in, and say your old CEO suggested you call him. But: Do not ask for a job.

How to Say It

“Joe Smith, my former CEO at ABC Company, strongly suggested that I get in touch with you. He thinks I should consider a job at your company. I’m a web developer and I’m trying to get a deeper sense of what’s important to your company in its web presence. I don’t believe in interviewing just because there’s a job open — I like to make sure I understand a business first, and to make sure I can offer something useful and profitable. Do you have a few minutes to tell me a bit about your IT philosophy and your organization?”

Don’t ask for a job

The point is to focus on what a CIO is interested in: strategy and philosophy of IT. Then let him (or her) talk. At the end, state clearly that you’re interested in working for his company and ask if he feels you’re someone the company would be interested in.

How to Say It

“If you think it’s a good idea, I’d like to talk with someone on your web development team who can tell me more about the operation.”

If he tries to send you to HR, politely explain that you’re glad to talk with HR, but first you’d like to get more information about the web work being done there. Here’s how to say it:

Note that you’re not trying to apply for a job through the CEO or CIO. The goal is to use your old CEO’s personal contacts to help you develop the relevant contacts you need in this company — in the IT department — not just to apply for a job.

Use the contact to make better contacts

Don’t be afraid of a C-level contact, and don’t feel awkward making these calls. You’ve been introduced. Talk shop with these execs, not about applying for a specific job. Use your conversations to learn about them and to expand your circle of contacts. Then ask for referrals to others in the company who can talk shop with you, and you’ll be in the door before you know it.

It’s almost always best, when you’re talking to someone higher up than you, to ask for advice and guidance. Use those exact words:

How to Say It

“I’d like to ask you for a little advice and guidance about how someone with my skills could help your web development team be even more successful.”

Bankrupt & Unemployed: How to Say It

In the last post, Bankrupt & Unemployed: Will a background check doom me?, we discussed how a reader who is applying for a job (and who is qualified) might overcome obstacles that come up when the employer does a background check. Problems like bankruptcy triggered by long-term unemployment — and a year-old DUI (driving while intoxicated) violation.

Knowing what to do is one thing. Facing the employer and knowing what to say — and being able to say it — is something else. In this edition, let’s discuss How to Say It.

There are two keys to convincing an employer to take a chance on you:

  1. Personal recommendations from credible people who know your character and your work ethic.
  2. A clear commitment — which the employer will never ask for, but which you must offer in order to get a job offer. To find out what that commitment should be, please watch the video.

Bankrupt & Unemployed: Will a background check doom me?

In the September 13, 2011 Ask The Headhunter Newsletter, a reader asks:

I have a challenge that I’m not sure I can overcome very easily in this job environment. I was forced to file bankruptcy due to long-term unemployment. I also received a DUI (“driving under the influence”) about a year ago. I’m afraid that, despite my qualifications, prospective employers may reject me after they do a background check. Any suggestions on how I can overcome this challenge?

My reply:

Here’s the video version of my advice, and below it is the printed version. (I don’t do videos from a script, so this is not a literal transcript.)

1. Avoid job hunting tools that can’t defend you.

Your resume cannot defend you when a manager sees a problem and wonders how it would affect his business. Nor can an online application form. Only someone who knows you can defend you and override objections by emphasizing how you’ll deliver benefits to an employer.

So the answer is clear: Invest most of your time getting someone who is credible and who respects you to contact the employer and recommend you. It’s not easy. But it’s the best tactic. A reference doesn’t have to be your former boss. It might be another manager from your old company who knows your work ethic, or even a customer or consultant. But it must be someone who will make the call and stick their neck out for you. (I know it might be painful to make such a request. But you’re in a painful situation, and like I said, you have to have the stomach for this.)

2. Help the employer focus on what matters most.

The employer is right to be worried. Any red flags pose a risk to his business. So it’s up to you to help the employer stop worrying. Be honest and candid about your bankruptcy and your DUI. But don’t dwell on them. Quickly focus the employer on your clear commitment to help him make his operation more successful. In other words, distract him from your problems in a way that engages him in what matters: his success. Show him that you’re worth taking a chance on.

Just remember: The manager who hires you deserves this kind of effort from you, because he needs convincing. He won’t ask you to do it. You must volunteer.

The economy sucks, and losing a job opportunity because you’ve got problems in your personal or work history sucks even more. What if you’re qualified and have a solid work ethic? Should an employer reject you because you were forced to file bankruptcy due to unemployment? How about a DUI violation? Should it hamper getting hired? How would you handle this?

Degree Inflation: Will it blow up in your face?

In the June 28, 2011 Ask The Headhunter Newsletter, a manager who has no college degree wonders how crucial a degree is, and asks whether it’s worth stretching the truth on the resume:

In the case of a successful manager, how important is a college degree to a headhunter? I don’t have a degree. With so much emphasis on education nowadays, should I fabricate the truth on my resume or completely eliminate the education section entirely? If I were to stretch the truth and include a degree on my resume, how often at my level of achievement does a search firm investigate?

Hmmm. I’m really worried about you. Just what kind of achievement is it to lie about your credentials? Can a successful manager believe it’s smart to even consider fabricating a degree?

Don’t lie and don’t stretch the truth. There’s an entire background-checking industry ready to expose you. Search firms investigate, but you don’t know how far, and they’re not going to tell you. If you lie about a degree, you will probably get caught. It could cost you an offer. Worse, because some of these background checks take time, the truth might not turn up until after you’ve been hired—then you’ll lose your new job.

If you think it’s bad to get caught by your employer, realize that once the headhunter finds out you lied, your name will be mud all over your industry.

Even white lies on your resume can blow up in your face. People might say, “Aw, everybody does it. Companies expect some inflation in a resume.” What do you want to bet? Your career? Your reputation? Let me remind you: Your integrity is everything. Protect it.

You will of course encounter headhunters who stick to the party line. If the client says it wants a degree, the headhunter will skip candidates that lack one. This is where the truly good headhunters will surface. They will guide and advise their client, and if it’s possible, they will help the client get past the lack of a degree to get to a good candidate that can do the job well. If you’re dealing with a headhunter who refuses to take you to the next step, it will buy you nothing to argue. Unless you have an inside track to the hiring manager, let it go. Move on to the next opportunity.

In the end, it’s up to you to have a compelling story to tell about how the employer will benefit from hiring you. The headhunter won’t figure it out for herself. You have to explain it.

If in the final analysis the lack of a degree continues to pose a problem, then get one. With all the good distance-learning schools out there nowadays, you will likely be able to skip some courses by testing out of them. Your experience will count for a lot toward the degree. Check with your state’s department of education for a list of accredited distance schools.

Everyone fudges a bit on their resume. It’s like stealing hotel towels. It’s expected.

Advice for the long-term unemployed

In the May 23, 2011 Ask The Headhunter Newsletter, a reader asks how “starting a business” can be the path from long-term unemployment to a new job.

Do you have any advice for the long-term unemployed? Since I’m not getting anywhere by job hunting, I’m considering starting a business, if only to keep myself busy! Then I remembered: You wrote somewhere that, in this economy, starting a business might be the best way to get hired. This sounds like a mental puzzle. Can you explain?

You say this sounds like a mental puzzle, but it really isn’t. You’ve been brainwashed to believe that your objective is to find a job. It’s not. Your objective is to make money and to earn a living. Shift your focus, and you’ll save yourself a lot of agony…

What does it take to start a business? You need a concept, a business plan, the right talent, and evidence that it will work. Ask any venture capitalist: That’s what she looks for before investing.

…To get a business started, you need to demonstrate that it will produce profit. Otherwise, who will give you money? Not investors and not customers. (Whether they realize it or not, this is why employers don’t give out job offers, either. They don’t see the profit.) So, you must bust your buns to produce a sound plan. That’s really what this is all about.

…In the process of producing a plan to start a business, you’ll show how you’d “do the job.” In courting investors and prospective customers, you’ll have proved your concept and yourself. You will have gone a hundred miles beyond the typical job candidate, who sits and answers canned questions with clever answers culled from some book that lists thousands of them.

What’s this got to do with ending long-term unemployment, and getting a job?

The plan is the job. When you deliver your business plan to a savvy prospective customer, to a potential business partner, to an an investor, to a supplier, or even to a competitor, you will find that some of these folks will want to hire you to work for them.

This is how I once landed a job. I shared my plans to start a business with the president of a company that would have been my competitor. (Don’t be surprised—such discussions happen all the time. Smart executives are always glad to meet with up-and-comers. It’s their way of defending their turf.) When he saw how good my plan was, he realized I would be serious competition. Since I’d “figured out the business,” that made me worth hiring. There was no job interview, just the discussion of my business plan. I planned this from the start, but the company president never figured that out. I made a lot of money for that guy—and for myself.

(Don’t wrinkle your nose or shake your head, just because this suggestion is foreign to your notions of what job hunting is. Remember? They’re not giving out jobs. So, why worry whether this is “proper job hunting?”)

People wind up long-term unemployed in this economy for many reasons. One step out of this quandary is realizing that you must be able to show how you’ll make money and profit — so, get to work starting a business. Formulate a plan — it can be a very simple one — and shop it around. Do you really think a resume would be more impressive?

Tired of being unemployed? Hire yourself. Or threaten to. A competitor might hire you first. Can a business plan really get you hired?

How to get noticed for a C-level job

In the May 3, 2011 Ask The Headhunter Newsletter, a reader asks how to get noticed among all the competition when competing for a C-level job, especially when he doesn’t have 100% of the “requirements” on his resume.

I believe I have a good, detailed resume. I am trying to make the jump from SVP/Division President to COO or CEO. How can I get noticed? I am also finding out that, in times like these, no one will talk with you unless you meet 100% of the requirements. Most of the times I meet 85%-95%, but I still get rejected. Any tips?

Think about this. Why would you apply for a C-level job by sending your resume to an X-level personnel jockey who’s working deep in the bowels of the company, far away from the C-suite? Honest, I’m just astonished at the degree to which smart, skilled managers get sucked into the bureaucratic herd mentality of corporate “recruiting” practices.

…Thanks to the prevalence of job-board databases, HR-department “resume scanners,” and the idiotic reliance on “keywords,” that’s where the problem of meeting 100% of the requirements comes in.

It used to be that someone with a brain would review a resume, read between the lines, and make an informed assessment about a candidate. That was before employers started soliciting thousands of applicants for one job. The most egregious example of executive job-hunting roulette is TheLadders, which claims to provide “exclusive” access to its “4.5 million subscribers”… for 50,000 “$100k+” jobs in its database! (Come look at the math.)

…We all know that you don’t need to be a perfect match to the job description to be the perfect candidate. So, how do you avoid being judged and rejected by your resume?

It’s simple: Avoid applying via resume!

Withhold your resume as long as possible. Navigate your way to a member of the board of directors or to the president of the company, without applying for the job. (Even a VP can help you get in the door.)

When you want to date a girl to get to know her, the last thing you say is, “You’re the perfect wife for me! Let’s get together to talk about getting married!”

Gimme a break. Show some finesse. Just because HR tells you to act stupid is no reason to do it.

Don’t walk blind on the job hunt. Establish a personal connection first. Rather than cry about your competitors, who seem to have the inside track, get on the inside track.

With this approach, you’re impressing a key decision maker or influencer with your acumen and your character — qualities that are not captured by keywords, but that are key decision factors for making a hire. Qualities that put you on the inside track.

How should you approach such top-level officers? By asking them for insight about the position that’s open.

You will be judged not by “100% of the requirements,” but by how you approach the challenges the company is facing. If the discussion goes well, suggest that you’d like to meet to discuss those challenges further. (Note that I said “discuss those challenges,” not “the job.” Top execs can smell a job hunter a mile away. They don’t want to talk about the job. They’ll let HR do that, with all those applicants who crowd the pipe. Top execs want to talk shop with a peer. Be that peer.)

That’s how you avoid an interview and have a friendly, peer-to-peer meeting instead. That’s how you get noticed for a C-level job: by behaving like a C-level exec.

If you’re a CEO, and you want to talk about acquiring another company, you don’t call that company’s HR department. You call the company’s CEO, or someone on the board of directors. So, why do you send a resume to HR when you want to talk about a CEO job?

I’d like to hear your stories about how you got in the door by going around HR to the decision maker — whether you were looking for a C-level job, or a staff position. It works the same way. The finesse comes in knowing how to get in the door without crawling through that sewer pipe full of resumes.

Presumptuous Employers: Is this HR, or Proctology?

In the March 29, 2011 Ask The Headhunter Newsletter, a reader complains that employers’ demands are very inappropriate. She says she’s applying for a job — not a loan. What’s up with consent forms to access personal credit records and other private information?

I had a good phone interview for a job that seems interesting. I’m visiting them next week for an interview. Today, they sent me an e-mail application (a wee bit premature… I’m not sure I want to apply until after the in-person interview) and, more shocking, a consent form to check my credit report. I think this is beyond inappropriate, not to mention the fact that my report is locked because my husband had his identity stolen a few years ago, and we have no idea where it was swiped from.

So, my question, how do I politely tell them I’m not filling out the forms until after the interview, and until I’ve decided to move forward? Do I even need to explain about the credit report? Is this a new thing? Why on earth would they need my credit report in the first place? They’re not loaning me money.

Proctology?Imagine being asked to fill out a marriage license and to take a blood test before you have a first date with someone. Or to hand over your credit report before visiting a car dealer? Or to bend over for an exam before going on a job interview?

The explanation for this is simple. The HR department at this company doesn’t recruit or impress. This company’s HR department practices Pure Bureaucracy. Clueless about attracting talent, it serves warrants for information instead. I’m surprised they haven’t asked you to provide a urine sample yet. (Don’t laugh.)

You are right to question the request, and to decline to provide the information until after you have met with the hiring manager. If the company doesn’t have adequate information on which to base an interview, then it should not be talking to you.

Will saying “No” result in the interview getting cancelled? It might. There is always the chance that a company will dump you if you don’t do what it asks. On the other hand, most such requests are routine, and when people ignore them, companies often don’t even notice until it’s “too late.”

Here are your options:

  • Politely tell them you’d like to meet with the manager first. “If there’s mutual interest, then I’d be glad to fill out the forms. But a meeting is necessary to help us both decide that.”
  • Just ignore the request, show up, and do the interview. If they ask where the paperwork is, don’t pretend you forgot or were too busy. That would make you appear irresponsible. Instead, use the statement above. By then, you’re there, and they can deal with it.
  • Give them what they want. I don’t think this is a good option, because as you point out, it not only puts you at risk, it’s inappropriate and it’s a waste of your time.

If they press you, and you’re still interested in talking to a company that funds a bureaucracy, I I’d be frank: Your credit is locked because your identity has already been stolen:

How to Say It
“Many companies rely on third parties to perform credit and background investigations, and I know some of that checking is done overseas, in countries with no privacy protections. Having been seriously burned, my policy is not to grant consent unless I know exactly who is doing the checking, who will have access to my private information, and what will happen to it afterwards. I don’t permit my private information to be stored in anyone’s database. My lawyer would slap me if I did otherwise — this has already cost my husband and me a lot of money. I’m sure you understand.”

You could also ask the employer to sign a letter accepting liability if your information falls into the wrong hands. Then ask for a list of names of people who will have access to the information.

How to Say It
“I’m sure you realize… [Sorry, you’ve gotta get the free newsletter for the rest…]

Invasions of privacy by employers who have no vested interest in you, and that have not put their own skin into the game yet, are common. This is not a new thing… But again — taking a strong position could cost you an interview or a job. It’s up to you how far you go…

Sometimes you’ve got to wonder which department you’re walking into when you appear for a job interview. Is this HR, or Proctology? If people keep letting employers, investigators and background checkers poke around where they don’t belong, can the doctor be far behind?

Do companies seriously believe they’re recruiting when they tell you to drop trou and stand for inspection? Even before an interview? That’s not recruiting. It’s a joke. How far will HR go to abuse people before it tries to attract them? How impressed are you with a company that behaves this way?

And HR wonders why there’s a “talent shortage.” The only shortage is of common sense when recruiting and hiring. What do you do when employers want to check your teeth before they make you smile? Readers’ Comments: Turn rejection into a very potent referral

In the March 14, 2011 Ask The Headhunter Newsletter, a reader says rejection isn’t so bad, if you learn something about your career objectives in the process. I think rejection can lead to a whole lot more.

I found work that I love and that I’m good at, at a small, award-winning company. My meetings with the hiring manager and her team were very positive, and we hit it off very nicely. I was called back for a third interview, with the general manager. He yawned a lot and clearly did not want to be interviewing people, but went through the motions. Perhaps he had already decided who would be hired. In any case, I did not get the offer. I don’t have a question. I just wanted to tell you that even rejection can produce a pretty positive attitude, because now I know that such places are still here, and I just have to find them!

Most job interviews result in rejection. But smart job hunters learn from every experience.

I think the most common lesson is that the candidate applied for the wrong job to begin with…

Your case is different, and it’s an important lesson of another kind. You actually found a job and a company that seemed to be right for you. You clicked with the manager and her team. And you walked away with renewed confidence that you’re going after the right kinds of companies — and that the jobs you want are in fact available. That’s all good news.

So this really is a win for you, and you should not waste it. I know that you will now go look for other such companies, but I’d like to suggest something even more powerful.

…Forget about the general manager and his poor attitude. Focus on the hiring manager and her team. These are people with whom you clicked. Focus on the good match you found with the company itself.

There are more such managers and companies. And they know one another!

So let’s get to work. Don’t waste your momentum… The hiring manager and her team members are potentially your best references right now.

Go back to your new friends at the company that didn’t make an offer. Thank them again for the stimulating meetings, and let them off the hook for not hiring you. Start with the manager, but then follow up with the other interviewers you clicked with.

How to Say It
“I know you can’t hire everyone, and I’m not troubled that I didn’t get an offer. But I’m glad that I met the kinds of people I’d like to work with. Thanks.”

Then let them talk. They will probably wish you well in your job search. But don’t let it end there.

How to Say It
“I wonder if I could ask you for a professional courtesy. You didn’t make me an offer — but if your appraisal of my abilities was high enough, I’d like to ask if you would be willing to serve as a reference for me. I’m planning to apply for jobs at companies X, Y and Z. Is there any one there to whom you’d be willing to recommend me?”

All you need is one referral and recommendation. If no referral is offered, don’t fret. Just say, “Thanks, anyway. Again, I enjoyed meeting you. I’d be glad to talk with you again if another position opens up.” But, if you get a referral, don’t just say thanks.

How to Say It
“Your faith in me means a lot. If I can ever repay the favor, please don’t hesitate to call me. I’ll let you know how it goes. Close with a thank you. Then contact the person you’ve been referred to, using the methods we’ve discussed here on Ask The Headhunter. …This is a very powerful way to leverage one good contact into another. It’s not such a long shot as it might seem. Since you made it through several rounds of interviews to the final one with the general manager, it seems the hiring manager and her team thought a lot of you. So my guess is, they may be willing to help.

If you get an interview based on this referral, remember that the reputations of the people who recommended you are on the line. Make them look good!

Now I’ll give you one more tip about how to make a rejection pay off, even months, if not years, after your interview. Stay in touch with the nice folks you met, and do them a favor. When you hear about an interesting opportunity — maybe it’s a job they’d be interested in, or a professional event, or even a sales opportunity for their company — , drop them a note (or call) and tell them about it. “You made an impression on me when you interviewed me a few months ago… and I thought I might return the favor by telling you about this…”

This is what makes the professional world go around.

The rare job interview turns into an offer. And few interviews yield friendships, or even mutual respect, between the employer and candidate. But even when two people click, they usually lose the momentum they’ve just found, and they both miss an opportunity. A rejection based on a strong interview can be turned into a powerful referral, if you know how. What do you take away from a great job interview, even if you are rejected?
